1. Agreement and operator
These Terms of Use are an agreement between the person using VIEWMIUM (“you”) and VIEWMIUM (“we,” “us” or “our”), the operator of the Service. They apply to VIEWMIUM mobile applications, the web atlas, supported desktop applications, public contributor pages and associated services that link to them (collectively, the “Service”).
By creating an account, selecting an acceptance control, purchasing Premium or using the Service, you agree to these Terms. If you do not agree, do not use the Service. A contributor, reviewer, editor, employee, contractor or institutional customer may also be subject to a separate written agreement. If a signed agreement expressly conflicts with these Terms, that agreement controls only for its stated subject and parties.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering this agreement. The Service is not directed to children. Do not create an account or use the Service if you do not meet these conditions.
You must provide accurate account information, protect your credentials, promptly notify us of suspected unauthorized access, and remain responsible for activity under your account to the extent permitted by law. You may not transfer, sell or share an account. Professional verification and a verified badge do not create employment, endorsement, licensure in any jurisdiction or authority to practice medicine.
If you use the Service for an organization, you represent that you have authority to bind it where the organization is the contracting party. Institutional access, student administration and private content require an applicable order form or enterprise agreement and are not granted by these consumer Terms.
3. Educational service and medical limitations
VIEWMIUM provides educational and reference materials, including curated de-identified imaging cases, annotations, articles, search, drawings, bookmarks, contributor information and optional AI-assisted explanations. It is not a medical device, healthcare provider, radiology service, diagnostic service, clinical decision support system, PACS, EHR, telemedicine service or emergency service.
Medical knowledge changes and cases may contain errors, incomplete context or jurisdiction-specific practice differences. Images are educational exemplars, not a complete clinical record.
- Do not use VIEWMIUM to diagnose, treat, monitor, triage or prevent disease in a particular person.
- Do not upload, paste, transmit or request analysis of PHI, personal health records or identifiable patient data.
- Do not rely on content, AI output, ratings, verification badges or certificates for a medical decision.
- For a health concern or medical decision, consult an appropriately qualified healthcare professional.
- For an emergency, contact local emergency services. VIEWMIUM does not monitor messages for emergencies.
4. Limited license
Subject to these Terms, VIEWMIUM grants you a personal, limited, revocable, non-exclusive and non-transferable license to access and use the Service for your own lawful education and reference. Premium access is limited to the period in which a valid entitlement is active. No ownership right is transferred.
Except where mandatory law permits it, you may not reproduce, distribute, sell, sublicense, publicly display, scrape, systematically download, reverse engineer, extract a dataset from, train a model on, remove notices from, or create a competing product from the Service or its content. Ordinary screenshots for personal study are permitted only if they contain no restricted material and are not redistributed.
5. Content, drawings and feedback
Atlas content is owned by VIEWMIUM or licensed by contributors and third parties. Attribution identifies a contributor but does not expand your license. Medical source files, annotations, translations and editorial metadata may have separate rights and restrictions.
You retain rights you have in lawful drawings, notes or feedback you submit. You grant VIEWMIUM a worldwide, non-exclusive, royalty-free license to host, reproduce and technically process those materials only as needed to operate, secure and support the feature, unless a separate submission flow clearly requests broader publication rights. You must not include PHI, confidential information or content you lack the right to use.
These Terms do not grant VIEWMIUM permission to use contributor medical cases or private user content to train a general-purpose or proprietary machine-learning model. Any such use requires a separate, explicit and appropriately documented opt-in.
6. AI-assisted features
The Service may identify a feature as “AI” or “AI-assisted.” When enabled, VIEWMIUM may send your question, language, structured atlas context and retrieved published text to the model provider disclosed before use. The AI feature does not send raw medical-image files. AI output is probabilistic, may be inaccurate or fabricated, and is not independently verified for your circumstances.
You must not submit PHI, patient-specific facts, secrets, credentials or unlawful content. Use AI output only for education and verify important claims against cited sources. VIEWMIUM may impose limits, filter prompts, refuse outputs, change providers or disable the feature for safety, legal or operational reasons. The AI Use Notice is incorporated by reference.
7. Premium and purchases
Premium may be offered as an auto-renewing monthly or annual subscription purchased through Apple App Store or Google Play. The price, billing period, trial if any, tax treatment and renewal terms shown in the purchase interface govern the transaction. The platform processes payment and normally manages cancellation and refunds. Deleting VIEWMIUM or your account does not by itself cancel a platform subscription.
The Subscription, Billing and Refund Terms are incorporated by reference. Nothing in these Terms limits non-waivable consumer rights. Web status display is not a separate web checkout unless a later release is approved and these Terms are updated.
8. Acceptable use and enforcement
You must follow the Acceptable Use and Community Rules. We may investigate, restrict visibility, remove content, suspend features, suspend or terminate accounts, preserve evidence, or report conduct when reasonably necessary to protect users, rights, security, the Service or legal compliance. We consider context, severity, repetition and risk, and provide notice and an appeal path where required and safe.
9. Intellectual property and third parties
VIEWMIUM names, interfaces, software and editorial compilations are protected by intellectual-property laws. Open-source components remain governed by their licenses. The Service may link to or interoperate with stores, identity providers and other third parties. Their terms apply to their services, and VIEWMIUM does not control them. Copyright complaints must use the Copyright and Takedown Policy.
10. Service changes and availability
We may update content, models, features and software, correct errors, perform maintenance or discontinue a feature. We will provide legally required notice for material changes. We do not promise uninterrupted availability, preservation of a particular case or model, or support for every device, operating system, country or language.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” VIEWMIUM disclaims implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. VIEWMIUM does not warrant that content or AI output is accurate, complete, current or suitable for clinical use.
To the maximum extent permitted by law, VIEWMIUM and its affiliates, licensors and personnel will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, loss of data, profits or goodwill, or medical or professional decisions based on the Service. Aggregate liability for other claims will not exceed the greater of US$100 or the amount you paid VIEWMIUM during the 12 months before the event giving rise to the claim.
These disclaimers and limits do not exclude liability or remedies that cannot lawfully be excluded, including applicable consumer guarantees, fraud, willful misconduct, gross negligence, death or personal injury where exclusion is prohibited, or statutory data-protection rights.
12. Termination
You may stop using the Service and request account deletion through the account controls or the support route linked from the VIEWMIUM site. We may suspend or terminate access for a material or repeated violation, unlawful conduct, security risk, required legal action or discontinuation of the Service. Provisions that by nature should survive will survive, including ownership, disclaimers, liability limits, dispute provisions and lawful retention obligations.
13. Governing law and disputes
Except to the extent mandatory law provides otherwise, North Carolina law governs these Terms without regard to conflict-of-law rules. Disputes may be brought in a court with jurisdiction in North Carolina. Consumers retain the benefit of mandatory laws and forums in their place of residence. These Terms do not impose arbitration or a class-action waiver.
14. Changes, notices and contact
We may update these Terms. For material changes, we will provide notice through the Service, email or another legally sufficient method and obtain renewed consent where required. The current version and last-updated date appear on this page. Questions and legal, support or privacy requests can be submitted through the support route linked from the VIEWMIUM site.
